Transatlantic Dialogue on Data Transfer: Standard Contractual Clauses
eco – Association of the Internet Industry & i2Coalition – Internet Infrastructure Coalition
invite you to an update on the transfer of personal data and data protection on both sides of the Atlantic.
Anyone wishing to transfer personal data from the EU to the US or other third countries must rely on Standard Contractual Clauses (SCCs), especially since the end of the EU/US Privacy Shield, in order not to risk a violation of data protection law.
The USA and numerous other third countries do not offer a level of data protection that is adequate for the General Data Protection Regulation (GDPR). With regards to the US, the European Court of Justice stated this explicitly in the summer of 2020, overturning the EU/US Privacy Shield. Since then, this important legal basis for the transfer of personal data from EU countries to the United States has been removed.
European companies with branches in the US or companies that wanted to use service providers on the other side of the Atlantic have been uncertain about how to meet their obligations under GDPR, and what the future holds for transatlantic data transfers. In this webinar i2Coalition and eco will explain the new Standard Contractual Clauses adopted by the EU Commission, which are now in practice the main legal basis for international data transfers. The participants will also discuss intergovernmental policy discussions about the future of data transfers between the US and EU that may not need to rely on the SCCs.
Join us for this Transatlantic Dialogue to discuss the application of the new Standard Contractual Clauses and the status of policy development on the protection of personal data on both sides of the Atlantic:
- What are Standard Contractual Clauses and why are there new ones?
- What is the difference between the new and the previous Standard Contractual Clauses?
- Do they provide full legal certainty / security?
- Who needs to use new Standard Contractual Clauses?
- How to use new Standard Contractual Clauses
- Feedback from the industry / Adoption rates in the US and in the EU?
- Status quo & foresight: data protection policy development in the US and the EU
- Insight into the current state of negotiations between the US and EU on a replacement for Privacy Shield, and potential for a US Federal privacy legislation.
